    That’s not true. The moment someone refuses to provide ID or given name, DOES NOT constitute probable cause. ANYTHING is probable cause these days. If you stutter when talking to the police in lincoln they will assume you are drunk or high on some hard drug for christs sake. And in the state of Nebraska, it is NOT illegal to be in public without ID. That’s just ludicrous and anyone who believes that is a law needs to reread the law books, because it’s not there.

    But remember the deck is ALWAYS stacked. LE has resisting, disturbance, interfering, smell of A/ID and in a pinch can say they suspected because of (whatever), then say (whatever) was a mistake but once they searched/pulled over/stopped/busted into house they found (next whatever).

    Just to to be exact, yes, on a call where a person is absolutely breaking a law (bow and arrow) then one must provide name/ID.

    If it had be legal to practice with bow and arrow, then if he would have been arrested for not providing name/ID most likely but it would of been dismissed.

    At which time they can attempt to identify the suspect…if they are unable to identify said person, they can be placed on an ICE hold..which is when Immigration takes over and attempts to identify the suspect..Not to mention if the suspect stupidly waives his rights for a speedy trial, he can sit in Jain for an unlimited amount of time…

    @CorpseMcGrinder: the moment one refuses to provide ID or give a name, they have just entered probable cause…Not to mention it is illegal to be in public with no proof of identification…check that in ur law books…just sayin…Also the fact the police were called and ur and dude fit the description given by the caller, and had the tangible evidence in hand, the police had justifiable cause to detain him…and anyone should know the police can detain a suspect for 48 hrs

    Now, this doesn’t mean that they DON’T do this. Police abuse their power all the time, and have no problems bending the law and lying on the stand when it suits the state prosecutor’s case.

    No it’s not incorrect. Look at the law books and it will clearly state what I have posted above. You DO NOT have to show ANY ID unless you are told by an officer that you are being placed under arrest. By what you have stated, you basically think that any cop at any time and for whatever reason, can just walk up to you out of the blue and ask you to identify yourself. They CANNOT do this, unless there is probable cause to make an arrest. Are you that brainwashed by the police?

    Also, home searches need a warrant from a judge, don’t matter what the cause is. Fourth amendment.

    They can be sued for failing to respect these constitutional rights. Know your rights.

    that’s slightly incorrect, a police officer can ask you to identify yourself at any time and you have to comply, you don’t have to produce an ID, but you must give a name, if you refuse, they can arrest you.

    i don’t believe that is true if they are investigating someone breaking the law ( and he did ) then they can ask. Things aren’t like they used to be when you could shoot a bow and arrow in the front yard. He should have just talked to the cop and probably just have gotten sited for it.

    They must first tell him he’s under arrest before he is REQUIRED by law to show ID. If they aren’t arresting him, he doesn’t have to show it.

    You only have to show ID if they tell you that you’re under arrest. If not, you DO NOT have to show ID simply because they ask you to show it.  It’s the law.
